Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the QVIKS platform operated by Simplethis s.r.o., a company registered in the Slovak Republic (ICO: 50779095, DIC: 2120470440), located at Cintorínska 3, 811 08 Bratislava, Slovak Republic.

QVIKS is a business management platform that provides contact management, booking, scheduling, payment processing, and communication tools for service professionals and their clients.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Definitions

"Service" refers to the QVIKS platform, including the web application at qviks.com, any associated subdomains, custom domains, and APIs.

"Admin" refers to a business owner or service professional who uses QVIKS to manage their practice, clients, bookings, and payments.

"Client" refers to an end user who interacts with the Service through an Admin's account — for example, to book appointments, view events, or make payments.

"Organization" refers to the Admin's business entity within QVIKS, including all associated data, settings, and connected integrations.

"Content" refers to any data, text, images, files, or other materials uploaded to or created within the Service.

3. Account Registration and Security

To use the Service, you must create an account with a valid email address and a secure password, or sign in via Google authentication.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@qviks.com if you suspect unauthorized access.

You must provide accurate and complete information during registration and keep it up to date. We reserve the right to suspend accounts that contain false or misleading information.

You must be at least 16 years of age to create an account. If you are under 18, you must have parental or guardian consent.

4. Use of the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including but not limited to data protection regulations (GDPR, CCPA, and other applicable privacy laws).

You must not: (a) attempt to gain unauthorized access to the Service or its systems, (b) use the Service to transmit harmful code, spam, or malicious content, (c) interfere with the Service's operation or other users' use of it, (d) reverse-engineer, decompile, or attempt to extract the source code of the Service, (e) use the Service for any illegal or fraudulent activity, (f) scrape, crawl, or automatically collect data from the Service without our written consent.

5. Admin Responsibilities

As an Admin, you are the data controller for the personal data of your Clients stored within QVIKS. You are responsible for: (a) ensuring you have a lawful basis to collect and process your Clients' personal data, (b) informing your Clients about how their data is used, (c) responding to data subject access requests from your Clients, (d) managing data in any third-party services you connect to QVIKS (e.g., MailerLite, Google Calendar), (e) ensuring your use of the Service complies with all applicable laws in your jurisdiction.

You are responsible for the accuracy and legality of all Content you upload or create within the Service. We do not monitor or review Content for legal compliance.

If you connect third-party services (Stripe, MailerLite, Google), you are responsible for reviewing and accepting their respective terms of service and ensuring your use complies with their policies.

6. Client Accounts

If you are a Client, your account was created by or at the direction of an Admin. Your use of the Service is subject to both these Terms and any additional terms or policies set by the Admin's business.

Your primary relationship regarding your personal data is with the Admin (the business you interact with). For questions about how your data is used, contact the Admin directly. For questions about the QVIKS platform itself, contact us at hello@qviks.com.

You can manage your account, export your data, or request account deletion at any time through your account settings, as described in our Privacy Policy.

7. Payments and Billing

Payment processing is handled by Stripe, a PCI DSS Level 1 certified payment processor. By making a payment through the Service, you agree to Stripe's terms of service.

QVIKS does not store credit card numbers or full payment credentials. We retain only payment references (session IDs, amounts, and statuses) for record-keeping.

Admins are responsible for setting accurate pricing, managing refunds, and complying with applicable consumer protection and tax laws in their jurisdiction.

Subscription and billing terms for the QVIKS platform itself (Admin subscriptions) are governed by the plan selected at signup. Plan details, pricing, and cancellation terms are available on our pricing page.

8. Intellectual Property

The Service, including its design, code, features, branding, logos, and documentation, is owned by Simplethis s.r.o. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service.

You retain ownership of all Content you upload to the Service. By uploading Content, you grant us a limited license to host, store, display, and process it solely for the purpose of providing the Service to you.

We do not claim ownership of your data. When you delete your account, your Content is removed as described in our Privacy Policy.

9. Availability and Support

We strive to maintain the Service's availability but do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We provide support via email at hello@qviks.com. Response times may vary based on the nature and complexity of your request.

We may modify, update, or discontinue features of the Service at any time. For material changes that significantly affect your use, we will provide reasonable advance notice.

10. Data Processing and Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Where we process personal data on behalf of an Admin (as a data processor), we do so in accordance with GDPR Article 28 and our Data Processing Agreement. We process data only as instructed by the Admin and implement appropriate technical and organizational security measures.

We do not sell personal data to third parties. We share data only with the third-party service providers described in our Privacy Policy, and only as necessary to provide the Service.

11. Account Termination

You may delete your account at any time through your account settings. Account deletion is permanent and will remove all your personal data as described in our Privacy Policy.

We may suspend or terminate your account if: (a) you violate these Terms, (b) your use of the Service poses a security risk, (c) we are required to do so by law, (d) your account has been inactive for more than 24 months.

Before terminating an Admin account due to inactivity, we will send a notice to the registered email address at least 30 days in advance. If the Admin does not respond, Client data associated with the Organization will be deleted.

Upon termination, your license to use the Service immediately ends. Sections of these Terms that by their nature should survive termination will remain in effect (including intellectual property, limitation of liability, and governing law).

12. Limitation of Liability

To the maximum extent permitted by applicable law, Simplethis s.r.o. and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.

Our total cumulative liability for all claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded by law, including liability for fraud, gross negligence, or death or personal injury caused by our negligence.

13. Indemnification

You agree to indemnify and hold harmless Simplethis s.r.o. from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your violation of these Terms, (b) your violation of applicable laws, (c) Content you upload to the Service, (d) your infringement of any third-party rights.

14. Third-Party Services

The Service integrates with third-party services (Stripe, Google, MailerLite, Vercel). These integrations are provided for your convenience and are subject to the respective third party's terms of service and privacy policy.

We are not responsible for the availability, accuracy, or practices of third-party services. Your use of these integrations is at your own risk.

The Service may contain links to external websites or resources. We do not endorse and are not responsible for the content or practices of any linked third-party sites.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on this page with a revised "Last updated" date and, where appropriate, by sending an in-app notification or email.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Slovak Republic, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Bratislava, Slovak Republic.

If you are a consumer in the EU, you retain any mandatory consumer protection rights granted by the laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent possible, and the remaining provisions will continue in full force and effect.
